(EB-5) INVESTOR /EMPLOYMENT CREATION VISAS


EB-5 IMMIGRANT INVESTORS

Up to 10,000 visas are available per year for investors in new commercial enterprises, if the enterprise will create employment for at least ten U.S. workers. Generally, an investment must be at least $1,000,000, but if an investment will be made in a "targeted employment" or "rural" area, it must be at least $500,000.                                                                                           

Forms and Documents:

The following forms and documents are or may be required to apply for an EB-5 Visa:

  1. Articles of Incorporation for the U.S. Company
  2. By-Laws, Shareholder Agreements, Share Certificates, and other Relevant Corporate Documents
  3. Proof of the company's operation history and evidences such as marketing and advertising materials;  invoices; contracts; commercial lease; bank account and accounting records; financial statements of the company, income tax returns, stock ownership 
  4. I-9 Forms and Payroll Records, showing that there is a minimum of ten employees in the U.S. company
The alien application should also provide the following information:
  1. Foreign resident address
  2. If reside in the U.S., a notarized copy of I-94 Card
  3. Social Security Number
  4. The position in the invested U.S. company and the remuneration
