(EB-3) SKILLED WORKERS AND PROFESSIONALS


EB-3 VISA 

The EB-3 classification is for skilled or professional workers. It includes individuals  with bachelor's degrees, but who do not qualify for the EB2 category, skilled workers with at least two years of training or experience, and unskilled workers. In order to apply for a EB-3 Visa, a labor certification and a job offer are required. 

Procedures

The applicant's employer should submit INS Form I-140 Petition for Alien Workers with the INS Regional Service Center that has jurisdiction over the location of your employment. EB-3 petitions also require an approved Labor Certification (Form ETA-750) from the Department of Labor.

Forms and Documents

  1. Qualifications and skills: skilled workers should have at least two years experience, either through hands-on experience or through post-secondary education; professionals should have at least a U.S bachelor's degree or a foreign equivalent degree
  2. A Job offer which requires the level of education the alien is claiming
  3. Approval of Labor Certification
